Club Terms of Service

Bay Area Athletic Club release of liability, waiver of claims, assumption of risk and indemnity agreement in relation to COVID-19 and other similar infectious diseases. By signing this release agreement, you will waive or give up certain legal rights, including right to sue or claim compensation following exposure to COVID-19 or related viruses and illness and death as result. PLEASE READ CAREFULLY.


I understand that the World Health Organization has classified the COVID-19 outbreak as a pandemic. I further understand that COVID-19 is a highly contagious and dangerous disease, and that contact with the virus that causes COVID-19 may result in significant personal injury or death.


I understand and accept that while Bay Area Athletic Club has undertaken the required steps as indicated by the department of public health to lessen the risk of transmission of COVID-19 in connection with the programs and services offered. Bay Area Athletic Club is not responsible in any manner for any risks related to COVID-19.


I agree to strictly comply with the COVID-19 Guidelines issued by the Club and may be amended from time to time as further information is obtained.  These Guidelines are posted at the club and on our website. I have read, understand and agree to this provision.


I am fully aware and accept all risks that participation at Bay Area Athletic Club carries with it inherent risks related to COVID-19 transmission (“Inherent Risks”) that cannot be eliminated regardless of the care taken to avoid such risks. Inherent Risks may include, but are not limited to, (1) the risk of coming into close contact with individuals or objects that may be carrying COVID-19; (2) the risk of transmitting or contracting COVID-19, directly or indirectly, to or from other individuals; and (3) injuries and complications ranging in severity from minor to catastrophic, including death, resulting directly or indirectly from COVID-19 or any treatment.


Further, I understand and accept that the risks of COVID-19 are not fully understood, and that contact with, or transmission of, COVID-19 may result in risks including but not limited to loss, personal injury, sickness, death, damage, and expense, the exact nature of which are not currently ascertainable, and all of which are to be considered Inherent Risks.


I hereby voluntarily accept and assume all risk of loss, personal injury, sickness, death, damage, and expense arising from such Inherent Risks. Furthermore, I represent and warrant that I do not suffer from any medical condition or disease that might in any way hinder or prevent me from receiving the Services, including, to my knowledge, COVID-19.


I hereby agree to contact Bay Area Athletic Club immediately for any of the following (1) I contract COVID-19; (2) I was in contact with anyone that contracted COVID-19; I experience any of the following Flu Symptoms; Sore Throat, Vomiting, Cough, Tiredness and Fever.

I fully understand and agree to the terms and conditions identified above and I agree to follow the COVID-19 Guidelines which I have read, and which may be amended from time to time as new information is obtained. I understand that if I contravene these guidelines, I will be removed from Bay Area Athletic Club immediately and may be suspended from Bay Area Athletic Club until suitable discipline according the club Discipline Policy.

Bay Area Athletic Club will accept cash, debit, Visa or Master Card for 12 month and 6 month payment options. All monthly payments must be paid with Visa or Master Card. All monthly payments will be automatically deducted at the first day of every month. There will be a $25 penalty fee for any failed monthly payments. All payments are final and non-refundable. 

Cancellations / Re-activation: 
If you wish to cancel this agreement, a 30 day written/email notice to Bay Area Athletic Club is required. During the 30 day notice period you are required to pay the regular tuition price. There will be a penalty of $25 per month for your remaining contract. This excludes the 30 day notice period. If you have cancelled your membership and wish to re-activate your account there will be a $99 activation fee. 

Student Absences:
The student and co-signer agree unconditionally to pay the above tuition without regard to the attendance made or classes missed. 

Hold Fee:
If you wish to put your membership on hold, a $25 hold fee will be applied to every month your membership is placed on hold. 

Additional cost:
All new students are required to purchase boxing gloves as their first piece of equipment plus a Bay Area Athletic Club Uniform. Full protective equipment will be required for all students enrolling in the Silver Gloves Program. Grading fee’s of $40 are due each time a student progresses to a new glove level which is approximately every three or four months. There is a separate fee structure for Bronze, Silver and Golden Glove graduations. All Camps, Birthday Parties, Parent’s Night Out, Tournaments, Special Events and Seminars are subject to additional fees. 

Club Closure:
Bay Area Athletic Club will close for all Statutory Holidays including the Friday and / or Saturday preceding the holiday. We also close on Easter Monday, 1 week at the end of August and during the Christmas Holidays. During inclement weather if the club is unable to provide classes, students will be notified by email as soon as possible. 

WAKO Canada Membership Fee’s
All members of Bay Area Athletic Club are required to pay a yearly membership fee to the National Kickboxing Association WAKO Canada. Bronze Gloves members will pay $15, Silver Gloves and up will pay $75. This amount will be deducted every calendar year automatically from your credit card on file. 

Video and Photo:
All of our classes will be photographed and or recorded for the purpose of advertising, marketing and celebrating. We do social media posts with class content on a regular basis. By signing this waiver you will agree to allow Bay Area Athletic Club to use this content for this purpose. 

Bay Area Athletic Club reserves the right to alter the days, hours of operation and classes if deemed necessary. Fees are subject to change without notice. 

Release & Waiver
I, the undersigned, understand that my membership requires that I adhere to the rules and regulations established for the health, safety and positive learning environment for all members.  Failure to do so will result in my removal from specific activities and/or from membership of the Bay Area Athletic Club. I, the undersigned also accept that there is always the risk of serious injury resulting from participation in any organized recreational activity offered by the Bay Area Athletic Club. I, the undersigned release and discharge the Bay Area Athletic Club and their coaches, instructors, and other members from any and all actions, causes of action, for damage, loss or injury, arising which may be sustained by me/my child in consequence of my membership.  I also agree that the Bay Area Athletic Club shall not be held responsible for any loss or theft of personal possessions. I, the undersigned, understand the payment plan selected and its requirements and limitations, as well as the Membership TERMS listed above.
